The legality of privately owned MTP. Empty The legality of privately owned MTP.

    Post by Rich83 Tue Apr 17, 2012 6:27 am

I have some MTP stuff, some from eBay and some traded within this sort of circle. Someone did tell me that MTP hasn't been released for surplus yet and as such we are not allowed it - is this true?

There are now websites selling the S95 MTP stuff (although I heard the official release was to be June/July) and obviously eBay is full of the stuff but that of course means nothing...

Bottom line is this - I have been offered an Osprey MKIV from a gent I met in the pub who is in the navy. He says he has a few and he has been selling them as they were supposed to just be destroyed but he saw an opportunity and took it. No armour or anything serious, just the cover.

What's the score then? Anyone know?

    Rich.

MTP and MK7s-plenty of rumours, ifs and buts but no concrete evidence and until i get a definite answer i wont be buying any of Ebay as again apparently the RMP keep an eye on Ebay and will/do prosecute buyers and sellers of the stuff.

As far as i am aware, MTP does not have the same restrictions on it as say CadPat. There was a lot of hoo-haa about it last year as some serving squaddies based in the UK were pi55ed off that civillians could get it and they couldn't get it until they went to Afghanistan.

New Ospreys and Mkvii helmets should be a no-no as they are limited issue and the guys who get them must use them in theatre. Used kit that has been written off is another issue although i think the ceramic plates are illegal but then so are respirators supposed to be restricted in case people buy them to go rioting and therefore be unrecognisable and safe from tear gas. Yet respirators still come up for release from the MoD ..........

New helmets and Ospreys will not be up for release.

New and used MTP is about and the licence to use it commercially is coming up very soon. Guys don't always use it all and if it is written off then they can dispose of it how they like - i think. My daughter's boyfriend is currently in Afghan and has told me i can have all the kit he has when he returns soon. That i will store and save for him as he will eventually feel nostalgic for what he went through and will probably wish he'd kept his kit. I'll then suprise him with it Smile

I've brought a couple of trousers and a UBACS and a shirt off eBay in MTP and had no come backs. And you see loads of Ospreys for sale.

You have been able to buy gas masks for years at any army shop. Also the old helmets. I have never seen the plates tho anywhere (other than eBay). The chap that offered me the Ospreys said that they were bringing out a mark five end of this year or start of next. I remember reading somewhere that it was frowned upon that the MKIV did not include a quick release system and was made quick as part of an urgent operational requirement deal.

There are people who say they have legally aquired Osprey's and new helmets - how does that work then?

Thats exactly my point Rich, loads have PEOPLE say this that and the other but we have no official proof as to what is or isnt legal regarding these.

Yes,gas masks and ration packs have been available for years but with MTP and MK7s,Ospreys etc they are(again) apparently taking things more seriously.

Im not trying to be a scaremonger here i just want to know 110% what the deal is regarding these issues and i would hate for anyone on here to get into any trouble for buying/owning anything illegal.

Its a story i dont want to get into as it ended in 3 days of hell for me with my house being turned into a crime scene and i wasnt allowed back into the house for that period of time.

All worked out ok but believe me it wasnt fun at all with half the Police force and armed response officers involved all for something innocent that could have been cleared up there and then.

Rich, there was an issue a whiles back with MTP clothing simply because it was so new that it shouldn't have been around long enough to be officially disposed of and the guys getting it weren't back from tour.

It's been around long enough now to have both been disposed of (especially the earlier stuff) or written off and the guys can dispose of as they feel fit - used or not.

It is just that helmets and body armour are restricted issue items so if you see new ones, they are unlikely to have been disposed officially. Used is different. The idea that some bloke in the navy is saying that Ospreys are being disposed of new even before the alleged new kit has been rolled out is rubbish.

As you are overseas, you are unlikely to get a visit from our SIB over any recent or future acquisitions any more than you might over CadPat.

I'll give a call to a friend at the Govt's current disposall contractors and verify that.

Dave, if you can get some sort of confirmation of the legality of owning MTP uniforms that would be superb,Of course it will always be the same ruling from MoD re: Body Armour, Gas Masks, but be able to own MTP clothing and not have the paranoias about having it in personal collections would be good indeed!!!!

DDPM Osprey's are common place, less the armour. I understand that items that are worn on the skin are not reissued i.e the Osprey cover is disposed of after a tour but the plates are not. The Ospreys he offered me, he told me are not battered but are issued. They are without plates and are just the covers.

Would be interesting to hear what your mate @ disposals said tho.

I spoke to a chap who runs an army surplus store and he told me that he sometimes gets SF soldiers who will come in and sell the Osprey and buy their own plate carrier and put the plates in that, sort of a personal preference thing.

I am reliably informed that MTP clothing is not 'officially' illegal to own as soldiers are at liberty to do what they like with stuff written off their form blah, blah, blah.

The disposal contractor apparently has "TONS & TONS" of MTP of all types in stock but cannot sell it on until June of this year. Then we'll see what variety of kit is out there.

Kevlar and ceramic insert and ballistic helmets are not disposed of - at least not yet - but the odd used one isn't thought to be an issue. New ones should not be available and the SIB would look actively into how it got where it got. There are a few squaddies who watch ebay and inform the authorities of things they feel shouldn't be out there. How often this gets taken up by said authorities is anyone's guess. The main concern isn't the odd guy selling something but serious crime from QM and in bulk.

I have a number of things from UKSF mates. Nothing illegal but they have a freer hand to use and dispose of things than the average squaddy. Those things are usually given to me on the understanding i do not re-sell for several years and with no names readable. I never refuse - it would be rude Smile Nor do i tell anyone what i have. Some things i collect and enjoy sharing, others i keep to myself. An SF helmet would come into the latter category.

I just like to add, my boss's brother in law which I will call M works for the MOD. He developed the Mk7 helmet and current issue vests along with a few others in his team. The boss always returns from his visits to his home with things he's been told to tell me and that which is quiet fun.

M has now left the personal armour side of the MOD and works nuclear subs on ..............

Does anyone have any links to some info RE the release dates? I always hassle a buddy of mine in the army for kit (which he can never get for me) and he told me he has to fill in three forms just to get a new pair of trousers...

I guess when the stuff is released the bottom will fall out of the prices on eBay, or at least we won't be seeing people selling smocks for £60... I really want one of those smocks but I'm not paying that!!!!

I also may take advantage of this guy selling Osprey's if the stuff is being released soon. I imagine that when they are more available the prices that he is offering me will increase as he will be able to more publicly advertise them. He said he has a few and I have wanted one for donkeys.
